Accordingly, you agree that you are solely responsible for all activities that occur under your account.
The University of Manchester shall not be liable for your interactions with any organisations, Sponsors, Creators, Helpers or individuals found on or through the Services. This includes, but is not limited to, delivery of goods and services, and any other terms, conditions, warranties or representations associated with listings on the Site. The University of Manchester does not exercise control over the timings or performance of Projects in any way; does not warrant that Sponsors’ pledges will be used for any particular purpose; and is not responsible for any dissatisfaction you may have regarding Creators’ use of Sponsors’ pledges, including any misuse of Sponsors’ pledges. All dealings are solely between you and such organisations and/or individuals as the case may be.
The University of Manchester is under no obligation to become involved in disputes between Sponsors and Creators, or between site members and any third party. In the event of a dispute, you agree not to pursue The University of Manchester, its officers, employees, agents, Sponsorcraft Ltd or successors in relation to any claims arising out of or related to such disputes and agree that The University of Manchester, its officers, employees, agents, Sponsorcraft Ltd and successors are exempt from and not subject to such claims.
Creators are solely responsible for fulfilling obligations both implied and stated in any Project they create. The University of Manchester reserves the right to remove a Project from the Services and cancel all associated Sponsors' pledges at any time for any reason.
Pledges, Payments and Fees
The University of Manchester, through the Site provided by Sponsorcraft, advertises and facilitates the collection of funds for Projects associated with or affiliated to the University, its staff, students and wider community.
Sponsors may make pledges in respect of a project. Once a pledge has been made, it constitutes a mandate for The University of Manchester (or a third party authorised by The University of Manchester, i.e. Stripe) to deduct the pledged funds from the Sponsor’s nominated account in the event that the project meets its minimum needed funding target. The Sponsor’s pledges are revocable by the Sponsor up until the point where the project reaches its minimum needed funding target. Once the minimum needed funding target for a Project has been reached, pledges in respect of that project become irrevocable. Funds will be transferred from the Sponsor’s nominated card or account once the timescale for the project is completed if the minimum needed funding target has been reached. All funds are collected from Sponsors via Stripe. Neither The University of Manchester nor Sponsorcraft Ltd is responsible for the actions of Stripe. The University of Manchester will deduct the Stripe processing fees from the Gift Aid raised on the project, then transfers the full donation amount plus remaining Gift Aid to the project creator. For further information on Stripe pricing, see here: https://stripe.com/gb/pricing.
If a crowdfunding project is not appropriate to claim GiftAid on then The University of Manchester will inform the Creator, as in this case the total Stripe transaction fees for the Project come out of the total raised (including matched funding). The University of Manchester will transfer to Creators all sponsorship monies pledged and paid by Sponsors within 28 days of receiving those monies into The University of Manchester’s Stripe account, provided that written confirmation has been received that the Project is ready to begin. While The University of Manchester will undertake reasonable due diligence to establish the credibility, accuracy and feasibility of a Project, The University of Manchester is not responsible for the completion of a Project. The University of Manchester offers no guarantee of successful completion of a Project, and will accept no liability for any failure of a Project to be completed or be undertaken to the Sponsor’s satisfaction. The University of Manchester may at its sole discretion audit, review, expedite, or assist Creators with a Project but has no obligation in this regard.
Sponsors should be aware that crowdfunding is a type of funding which by its nature entails a risk that the project is unsuccessful, does not fulfil its STATED objectives, DOES NOT FULFIL THE EXPECTATIONS OF THE SPONSOR or is not completed, and that there may be unforeseen practical, financial, logistical, administrative, legal or personal problems which hinder or prevent the successful completion of a Project. FUNDS ARE TRANSFERRED AT THE RISK OF THE SPONSOR, AND ARE NOT REFUNDABLE, except where a promised reward has not been delivered or in the rare cases where the Project cannot go ahead as planned due to factors outside the Creator’s control (and as determined by The University of Manchester in its sole discretion). In the rare cases where rewards cannot be delivered as promised, Creators should contact Sponsors directly to make an alternative satisfactory arrangement. Where this is not possible, a refund can be requested. The University of Manchester will make this refund to the Sponsor (this usually takes 5-10 working days via Stripe), and the Creator is obliged to reimburse The University of Manchester within 28 days of receiving written notification from The University of Manchester that the refund has been made to the Sponsor. In the event that a Sponsor suspects an unlawful misuse of funds, or fraudulent conduct, the Sponsor should contact The University of Manchester immediately with details of such allegations, and The University of Manchester will use its reasonable endeavours to investigate any credible allegations. In the event that an unlawful use of funds is demonstrated to the reasonable satisfaction of The University of Manchester, The University of Manchester will refund pledges submitted in respect of the Project in question and do it all can to recoup the funds from the Creator (but does not guarantee that it will successfully recoup such funds from the Creator).

Terms which apply to Creators only (and not Sponsors or Helpers)
The University of Manchester acts as an intermediary between you and Sponsors and other users of the Site.
When you register a Project with The University of Manchester, you represent, warrant and undertake to The University of Manchester and all users of the Site that:
- you are a current student of or member of staff at The University of Manchester and will be for the duration of your crowdfunding campaign, i.e. from the date on which the campaign goes live through to the end of your project and fulfilment of your rewards; \
- you are 18 years of age or older;
- you are the person or persons with ultimate responsibility for the Project (or are otherwise acting with the express authority of that person or persons);
- you will obtain, maintain and renew (as applicable) any necessary approval, authority, consent, licence or any other permissions in relation to your use of the Services to achieve funding for the Project and comply with all applicable laws;
- you will apply all Sponsor pledges received in accordance with the Project’s stated aims;
- you will not offer securities/financial instruments in return for Sponsor pledges;
- you will not misuse any Sponsor pledges, including not using any monies pledged for purposes which are not stated aims of the Project;
- you will not misuse the ability to message Sponsors or use it to send abuse (as defined under ‘Your use of information’ in the University of Manchester Hubbub Privacy Notice here. You will use the ability to message all Sponsors or Helpers to provide updates on the progress of the project they have sponsored or to thank them and provide rewards only, both during the sponsorship period and after the completion of the project (e.g. to report on its success and impact);
- if a Sponsor consents to the provision of their personal information to allow the fulfilment of Rewards linked to their pledge and you are required to use this personal information then you will use this personal information for fulfilment of the recognition only, and securely delete it from your records once this purpose has been fulfilled.
The University of Manchester will enable Sponsors to add Gift Aid to their donation if applicable. In order for Gift Aid to be claimed on donations, Sponsors must make a declaration that they meet all HMRC conditions.
Sponsors must pay an amount of income tax and/or capital gains tax at least equal to the tax that the charity, or collective charities they donate to, reclaim on their donations in a single tax year (currently 25p for each £1 given). If a Sponsor pays tax at the higher rate you can claim further tax relief in your Self-Assessment tax return. Any rewards offered by Creators are gifts given voluntarily to their Sponsors, and not services or items received in return for the donation. However Creators must comply with HMRC rules in respect of Gift Aid, and will not offer rewards with a value of more than 25% of the value of the donation up to £100, or of more than £25 for donations over £100.
If we are able, taxed reclaimed from Gift Aid will be put towards the Project, the corresponding gift is given in support of, less processing fees. The University of Manchester deducts the Stripe processing fees from the Gift Aid raised on the Project, then transfers the full donation amounts plus Gift Aid to the Creator. If a Project is not appropriate to claim Gift Aid on then The University of Manchester will inform the Creator, as in this case the total Stripe transaction fees for a Project comes out of the total raised (including matched funding).
General legal terms
The University of Manchester may transfer its rights and obligations under the Terms to another organisation, and The University of Manchester will always notify you in writing if this happens, but this will not affect your rights or The University of Manchester’s obligations under the Terms.
You agree that if The University of Manchester does not exercise or enforce, or delays in exercising or enforcing, any legal right or remedy which is contained in the Terms (or which The University of Manchester has the benefit of under any applicable law), this will not be taken to be a formal waiver of The University of Manchester’s rights and that those rights or remedies will still be available to The University of Manchester (and does not mean that you do not have to comply with your obligations). If The University of Manchester does waive a default by you, The University of Manchester will only do so in writing, and that will not mean that The University of Manchester will automatically waive any later default by you. This contract is between you and The University of Manchester. A person who is not a party to the Terms has no right to rely on or enforce any of the Terms.
Each of the paragraphs of the Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
Your statutory rights as a consumer are unaffected by the Terms and you may have rights under statute additional to those granted by the Terms. If in doubt you should contact your local Citizens’ Advice Bureau or Trading Standards Office.
The University of Manchester will not file a copy of the contract between you and The University of Manchester.
Where the words "in writing" appear in the Terms, this includes email. If you wish to contact The University of Manchester in writing, or if any provision in the Terms requires you to give The University of Manchester notice in writing, you can send this to The University of Manchester by email to firstname.lastname@example.org, or by post to The University of Manchester, Oxford Road, Manchester, M13 9PL.
The Terms, and your relationship with The University of Manchester under the Terms (including the subject-matter of the Terms and the formation of the contract, and any contractual or non-contractual dispute associated with your use of the Services), are governed by English law. You and The University of Manchester agree that the courts of England and Wales shall have non-exclusive jurisdiction to resolve any such dispute. Notwithstanding this, you agree that The University of Manchester shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
